Hi
I am new to this forum but also in the position where we have not been able to pay anything off our loan in the last 18 months. We paid € 198,000 for our property in Lacanau and a recent valuation we received was for € 31,000! We have written to our bank on a number of occassions to ask for a payment holiday until we start receiving rent again but they have never replied - we just keep receiving monthly notifications of the increasing arrears.
I phoned the bank a couple of months ago and they advised that it was too late for negotiations and that the property would be sold at auction - nothing since. We are concerned about the French bank chasing us for the outstanding arrears, likely to be excess €100,000 if the property only sells for that small figure. Does anyone know how far they can take this - I have heard that there is a chance that they could take a lien on our family home in Ireland and that if we sell it in the next 12years they could look to recover the outstanding debt. Can anyone please advise?

Oh that is bloody terrible . Have you tried to sue the management company for the rent that they owe you ??????You need to do this . There are many peopl on this forum
that have done that and got the rent owed to them . You will have to pay a Solicitor some money to prepare the papers for you but it would be worth it if the management company paid you the back rent ?? please look in to doing this . Yes my property was E200,000 and worthabout E40,000 ....IT IS A DISGRACE .......somebody has to be responsible for this scam. I have written to the French Ambassador again todday to find out who is the person(I could ring their neck) that devised this scam .
I have asked the question here a few times about defaulting but nobody seems to reply to this so I cnnot help you. I think we are all in the EU and so I don'tt expecty that the agressive French banks will let you off the hook but why don't you go and sue them before they get you then you would have a case against them which is better than nothing against them ...right ?
They are also responsible for you getting in to this mess in the first place . If you have no money you can apply for French Legal aid which would help you to get somewhere .
Can you join with 2/3/8 ohers from your complex and sue the management company for the old rent in a class action...so would cost a lot less ?
read this forum and contact some of the people on it that have sued .
