I have been concerned about what would happen to my French leaseback property if I die.
I have a French mortgage with mortgage life assurance, so the mortgage will be paid off (supposedly)
if I die. But what would happen then about local taxes, site management fees and letting company fees for a running lease ?
I have never seen this question asked directly here and can find no information on Google.
We have been through this once with French property but not a leaseback but I think the same would apply. Your successor would need to prove your Will in France through a French Notaire - they will then take the necessary steps to inform all the parties concerned. Your successor would probably need to set the ball rolling so to speak with the French bank etc about the mortgage. It might be best to have a will in French as depending on where your property is, the local notaire may not understand an English Will and request a translation. Your successors will probably need to provide copies of all the relevant certificates - death, birth and marriage (of successors) and passport info. Best to give copies or authenticated copies as originals can disappear into the French archives. It took us quite a long while but it was over 24 years ago and before the internet so probably much simpler now. I am sure Sean will advise.
