I have a leaseback in Normandy at haut Val, Belleme. I dont know if there are any others here in the group. We have been through the usual trauma with the mangement company going bust and cancelling the leases back in 2011-12 with the further complication that not all of the site was finished.
There is a hotel on site that was taken over by DCG but the terms they offered us at the time were so bad that a number of us refused to sign a fresh lease with them.
At the time the law had not been changed (or if it had we were unaware of it) and in order to deal with the situation we set up a Uk company limited by guarantee which then registered with the chamber of commerce to do business in france and the owners granted a leaseback compliant lease to this company. We then found a local guy to run the resort for us. There are further legal complications to make sure we all didnt have to repay the VAT which I will not bore you with.
We now have an operating resort but the costs and complications of doing business in France are such that the option of keeping our company registered in france is no longer viable and we have been looking at other legal ways of doing things. We are very interested in the yearly management contract idea. The local guy who runs the resort is willing to offer a lease but weand says he is unaware of the type of management contract we suggest. Many of us are are not keen on signing a fresh lease with him.
I wonder if anybody on the forum would be willing to let us have a sight of the type of year to year french contract they have with their local management company so that we can see what is involved. It would also be really useful if any-one knows of an immobilier or other business in the Basse Normandie area which provideds this service.
