Hi
There is a lot of bits and pieces of advice here, i.e. command the payer, setting up a residents association etc. I would like to know if someone can recommend a solicitor (preferably in Cote D'Azur) who has gone through the entire process and reached an outcome, i.e. successfully evicted the tenant. I think we have to be careful here that we don't get legal professionals touting for business and ending up with stacks of folders from different developments with each of them 'ongoing' (i.e. a long protracted process that is quite lucrative). In my opinion a solicitor who takes on too much work is a waste of time.
I strongly believe we have already been stung by the French legal system. Notaires are still overseeing deals on leasebacks and we all know that this type of investment is going down the tubes. They claim to represent the best interests of the buyer and the seller but how can they justify this claim? France seems to pride itself on the rigour of its legal system. For most of us this legal system has been part of an overall system inlcuding agents, developers & banks that is leaving most of us in a serious financial situation.
I reiterate my call, is there a solicitor out there worth his/her salt who can get us a satisfactory outcome?
A bilingual French lawyer is currently issuing some
'commandment' requests on Rhode Tourisme. His name is Fabian Cordiez.
This is the first step in recovering unpaid rents. Setting up owners
comitees is a good idea, but the process will take time. As for serving
a mere 'mise en demeure', this is a waste of time since this hardly has
any legal value. Remember, your lease states that you should serve a
'commandement' first.
