selling leaseback

I have a friend prepared to take over the lease (subject to mortgage) and to continue with the same terms. Do I need the management companies permission or do I just somehow formally notify them (via Notaire?).

BTW the lease has just ticked over the initial 9 years. Neither the management company nor myself have made any representations as to the next step. Is this significant? Will this cause any complications?

Late Payment of Rent

Recently our management company advised that if we are late paying the maintenance charges that they will add penalties which are very significant. They also passed a resolution at the AGM that stated that they could seize overdue payments for the rent cheques.

Does anyone know if this is legal.

Also can anyone advise if we are entitled to charge interest where rent due is late

Leasebacks 2010

Hi All.

I have read all the negative stories about leasebacks on this forum and I sympathise with anybody who has found themselves in difficulty with a leaseback property.I bought 2 different leaseback properties in 2005 (different management companies etc,) and thankfully both are functioning as they should.The rent is covering capital mortgages on both properties.Just wondering what people think, would I be crazy to consider a 3rd leaseback?

Hi forum

I have a property up for sale which is a leaseback and I am selling it as

'classic' apartment. I know I will have to pay the VAT back after sale. Does

anyone know how sales are dealt with in France..ie Does the seller use same

Notaire as buyer? Are their any fees when selling? any helpful advice from

anyone who done same...thanks in advance

TVA on Rental

Who receives or collects and keeps the 55.% & 19.6% (assume this is VAT)

on the rental?

I have property with parking which is 100% leased out as I have no

personal usage. I receive the 5% rental from the management company

which amounts to 5352 euros as per the bail de commersial. They have

this year for the first time, sent me an annual statement quoting:

Loyer TTC 6340 euro;

Loyer HT (5.5%) 5519 euro;

Loyer HT (19.6%) 433 euro;

TVA @5.5%303 euro;

TVA @19.6% 85 euro:

Claims should be submitted, by registered mail (with a receipt for the addressee to sign), to:
