Sale to my own company

Im thinking of selling my leaseback house at Golf des Fontenelles to my company as it will help financially. I wondered if anybody could recommend a notaire who understands leasebacks and could hande the tranaction. Even though the sale is from myself to the comanywhich i own 100% i'm assuming i will still need to pay the full transfer taxes as if it were a third party sale.

Does anyone have any experience of this company (Residis)?  They have purchased this apartment block from Global Exploitation/Suite Etudes and it is now being used for social housing. We are being asked to sign a new lease that officially allows the building to be used for social housing.  

When does 20 year TVA (VAT) start?

The 19% TVA on purchase price of a leaseback property was returned if you signed a 'bail commercial'. If the property goes out of lease at any stage then you have to return the TVA on a 1/20th basis (for as many years are remaining in the 20).

My question is when does this 20 year period start exactly ?

  1. is it when you sign the lease?
  2. is it when you complete the sale of the property?
  3. is it when the property first comes available for tourist rental ie. the residence de tourisme opens for business ?
  4. other ?

French social taxes

Are French social taxes due on Leaseback/para hotel rented properties for U.K. non resident owners? Have heard that we might now be liable for 7.5% . No idea if this is correct or not and Google research not very clear on the subject! So far have never been asked for it but maybe need to fill in an additional tax declaration? Anyone wise about this please?

annual costs

Hi all,

We are currrently paying 27 euro per square meter fixed costs (coverin in fact all costs, electricity, syndic,...) that per our contract can be raised with 1,5 % each 3 years.  but now we received a letter that due to the exceptional situation in 2022-2023 (inflation, energy costs exploding, lack of snow) they are forced to raise this to 33 euro per square meter.  We wonder if we can challenge this raise ? Anybody who was in similar situation ?
